TERMS OF SERVICE — mokap_lab

The scope is exactly what the quote you are accepting describes: its stages and deliverables. Anything not listed there (for example copywriting, illustration, photography or additional integrations) is not included — and we will gladly quote it separately if you need it.

Every deliverable includes up to two rounds of adjustments, so it turns out the way you imagined. Changes to something already approved, or new features, are discussed first, agreed in writing and quoted as additional work before they happen. That way neither of us gets surprises.

The project starts with the deposit and moves forward in stages, as the quote sets out. Every invoice comes with its due date and transfer details. If an invoice remains unpaid, work may be respectfully paused until we are up to date — and it resumes immediately once payment arrives.

For 30 days after launch, any functional defect (something that does not work as specified) is fixed at no cost and with priority. The warranty does not cover new features, content changes, or damage caused by modifications we did not make. Once the warranty ends, the monthly maintenance plan is available to keep looking after the project.

Once the project is paid in full, the site or application and all its contents are yours. The tools, libraries and base code that mokap_lab reuses across projects remain mokap_lab's, and you hold a permanent licence to use them within your project at no extra cost. The domain is registered in your name whenever possible.

If at any point you decide not to continue, nothing bad happens: you pay for the work done up to that day, you receive what has been built, and we part on good terms. Payments for stages already completed and delivered are not refunded.

The monthly plan covers what your quote describes (adjustment hours, support, monitoring and backups). If one day you would rather manage things yourself, we offer a full handover of your project to your own accounts within 15 business days — that is a promise, not a threat. If the infrastructure sits in mokap_lab's accounts and there is neither an active maintenance plan nor a handover, services may be suspended, always with 30 days' notice.

mokap_lab may show the finished work in its portfolio, crediting your brand. If you would rather it did not appear, just say so in writing and we will respect it.

This agreement is governed by the laws of Victoria, Australia. And any disagreement gets talked through first — always.

When you accept the quote online, your name, the date and the version of these terms are recorded. That is the receipt for both sides, for your peace of mind and ours.
